Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Sweats mobile application and related services (the "Service"), operated by Sweats Fitness ("Sweats", "we", "us", or "our"). By creating an account or using Sweats, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to use Sweats (or the minimum age of digital consent in your country, if higher). If you're under the age of majority where you live, you confirm you have your parent or guardian's permission to use the Service.

2. Accounts

• You're responsible for the accuracy of the information you provide and for keeping your account credentials secure.
• You're responsible for all activity that happens under your account.
• Notify us immediately if you suspect unauthorized use of your account.
• You may delete your account at any time from Settings → Account → Delete Account.

3. Acceptable use

Sweats is built around real people training together. To keep it that way, you agree not to:

• Harass, bully, threaten, or abuse other users
• Post content that is illegal, defamatory, hateful, sexually explicit, or otherwise objectionable
• Impersonate another person, or misrepresent your affiliation with any person or entity
• Falsify activity data, cheat in challenges, or manipulate leaderboards
• Upload spam, malware, or content that infringes someone else's intellectual property
• Scrape, reverse-engineer, or interfere with the Service's normal operation
• Use the Service for any purpose that violates applicable law

We have zero tolerance for objectionable content or abusive behavior. Violating this section may result in content removal, suspension, or termination of your account, at our discretion.

4. User content & license

You retain ownership of the posts, photos, videos, comments, and other content you submit to Sweats ("User Content"). By posting User Content, you grant Sweats a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service — for example, showing your posts in feeds, challenges, and tribes you're part of. This license ends when you delete the content or your account, except where copies persist in backups for a limited period.

You're solely responsible for your User Content, and you confirm you have the rights necessary to post it.

5. Reporting & moderation

Every profile, post, comment, and message thread can be reported directly in the app, and you can block any user to stop them from contacting you or seeing your content. We review reports and take action — including content removal or account suspension — for violations of these Terms. If you encounter content or behavior that concerns you, please report it in-app or contact us at the email below.

7. Subscriptions & billing

Sweats offers an optional auto-renewing subscription ("Sweats Pro") that unlocks additional features, such as extended AI Coach usage and verification requests.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-renewal: subscriptions automatically renew for the same duration and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Managing or cancelling: manage or cancel your subscription anytime in your Apple ID account settings (App Store) or Google Play account settings — cancelling in Sweats' own settings will not stop the platform-level billing.
• Free trials, where offered, convert automatically into a paid subscription unless cancelled before the trial ends.
• Refunds are handled by Apple or Google according to their respective policies — we don't process payments or refunds directly.
• Current subscription options, durations, and pricing are displayed in the app before purchase.

8. Intellectual property

The Sweats name, logo, app, and all associated software, design, and branding are owned by Sweats Fitness and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks or branding.

9. Third-party services

Sweats relies on third-party infrastructure — including Supabase, RevenueCat, and Apple/Google platform services — to operate. Your use of features backed by these services (subscriptions, HealthKit, push notifications) is also subject to the relevant provider's terms.

10. Termination

You may stop using Sweats and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if required by law. We'll make reasonable efforts to notify you of enforcement action taken against your account, except where we believe notice would compromise safety or an investigation.

11. Disclaimers & limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, to the extent permitted by law. We do not guarantee the accuracy of activity data, AI Coach responses, or user-generated content. To the fullest extent permitted by law, Sweats and its affiliates won't be liable for indirect, incidental, or consequential damages arising from your use of the Service.

12. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the courts of Kochi, Kerala, unless applicable law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by other reasonable means before the change takes effect. Continuing to use Sweats after changes take effect means you accept the updated Terms.
